Cuba Clarifies the Validity of Existing Type Approval Certificates Under Resolution 2/2026

When Cuba's Ministry of Communications (MINCOM) published Resolutions 1/2026 and 2/2026 earlier this year, one key question emerged: what would happen to certificates issued under the previous regulatory framework?

The wording of the Transitional Provision suggested that existing Homologation, Acceptance and Conformity Assessment Certificates would only remain valid until the new regulation entered into force on 20 July 2026, creating uncertainty for manufacturers with active approvals.

Following discussions with MINCOM and our local partners, the authority has now issued an official implementation instruction clarifying this point.

Existing certificates remain valid

The General Directorate of Communications has confirmed that certificates issued before Resolution 2/2026 entered into force will not be cancelled. Instead, they will remain valid until the original expiry date shown on each certificate.

This means manufacturers can continue importing and commercialising products covered by existing valid approvals without requiring immediate re-certification.

No immediate recertification required

MINCOM has also instructed its departments to continue issuing Technical Authorisations based on certificates granted under the previous framework. As a result, certificate holders and importers are not required to submit new Homologation applications solely because Resolution 2/2026 has entered into force.

Renewals under the new framework

While existing certificates remain unaffected, renewals will now follow the procedures established by Resolution 2/2026.
In summary:
  • Existing certificates remain valid until their original expiry date. 
  • Renewals will be processed under Resolution 2/2026. 
  • New applications are already being handled under the new regulatory framework.
