Ghana’s NCA Public Consultation on Two Communications Bills

The National Communications Authority (NCA) has opened a two-week public consultation on two draft bills that stand to reshape Ghana’s communications landscape. The proposed National Communications Authority Bill, 2025, and the Electronic Communications Bill, 2025, seek to overhaul legislation that dates back to 2008, aligning regulatory frameworks with the realities of digital transformation, data-driven services, and new connectivity paradigms.

National Communications Authority Bill, 2025 
· Strengthen and modernize the regulatory and institutional framework of the NCA—clarifying its functions, powers, and governance. 
· Promote transparency, efficiency, accountability, and alignment with emerging digital and technological trends. 
· Enhance coordination between the NCA, the government, and other sector regulators for coherent communications sector regulation.

Electronic Communications Bill, 2025 
· Repeal and replace the Electronic Communications Act 2008 to modernize and consolidate Ghana’s legal and regulatory framework for electronic communications, broadcasting, and related digital services. 
· Promote fair competition, innovation, and investment in the communications and digital ecosystem. 
· Strengthen the NCA’s regulatory powers and processes in spectrum management, licensing, interconnection, and infrastructure sharing. 
· Enhance consumer protection, data privacy, cybersecurity resilience, and universal access to communications services. 
· Ensure alignment with emerging technologies, international best practices, and national digital transformation objectives.

The consultation period runs from 16 October 2025 until 29 October 2025.
Stakeholders, including licensed service providers, civil society organizations, consumers, and the general public, are invited to submit written comments below.
