INDOTEL opens public consultation to reform the General Telecommunications Law 153-98

The Instituto Dominicano de las Telecomunicaciones  (INDOTEL) announced the opening of a public consultation for the reform of General Telecommunications Law No. 153-98.

The public consultation began on December 23, 2025, and will remain open until January 30, 2026. During this period, service providers, digital ecosystem stakeholders, and the general public may submit observations, comments, and suggestions on the preliminary guidelines of the proposed reform.

Key impacts and proposed changes

1. Equipment Homologation and Digital Security
Revision of Homologation Rules: The reform proposes a review of current equipment homologation rules to ensure they align with the principles of interoperability and digital security.

Establishment of Mandatory Standards: INDOTEL will be granted clear regulatory capacity to establish international security standards that are compatible with the Dominican legal framework.

2. Digital Rights and User Protection
Privacy and Data Protection: For devices that interact with the Internet of Things (IoT) or other digital platforms, manufacturers must ensure they can guarantee the privacy of communications and the security of data generated by users.

Protection Against Abusive Practices: The reform includes new protections for users against unsolicited communications (spam) and ensures that digital services are accessible, including for people with disabilities.

3. Spectrum Management and Efficiency
Efficient Spectrum Use: The reform emphasizes the efficient management and planning of the radioelectric spectrum. Manufacturers must ensure their devices comply with these updated technical standards to avoid interfering with other services.

Neutrality Principles: The inclusion of technological neutrality as a fundamental principle is intended to allow the use of any technology in providing services, which may affect the technical requirements for device certification.

4. Administrative Simplification
Regulatory Efficiency: In line with the "Zero Bureaucracy" goals, the reform aims to simplify administrative procedures related to the deployment of digital infrastructure and potentially the processing of technical permits.
