The "Regulation for Certification of Information and Communication Technology Equipment," approved by Resolution No. 24 of the Communications Regulatory Commission (CRC) of Mongolia, establishes the requirements and procedures for the certification and conformity assessment of radio and communication devices to ensure human health, environmental safety, and efficient radio frequency usage.
Scope and Impact
The regulation applies to Mongolian citizens and legal entities (applicants) involved in the import, domestic production, or export of information and communication technology (ICT) equipment. Key aspects of the regulation include:
Mandatory Certification: Required for all equipment included in the official list of products subject to mandatory conformity assurance.
Voluntary Certification: Available for equipment not included in the mandatory list.
Certification Categories: Certification is classified into three types: Import Certification, Domestic Production Certification, and Export Certification.
Permitted Radio Bands and Technical Parameters
All certified equipment must adhere to the following technical constraints:
Frequency Allocation: Devices must operate within the designated ranges specified in the National Radio Frequency Allocation Table of Mongolia.
Technical Standards: Equipment must comply with international and national standards regarding radio frequency (RF), electromagnetic compatibility (EMC), and electrical safety (Health & Safety).
Compliance: Technical parameters must meet the specific conditions and requirements approved by the CRC.
In-Country Testing and Conformity Assessment
The conformity assessment process is managed by professional experts and working groups appointed by the CRC. Requirements include:
Test Reports: Applicants must provide valid test results covering Health & Safety, EMC, and Radio Frequency parameters.
Laboratory Recognition: Test results from international or regional laboratories may be accepted if recognized under mutual recognition agreements or treaties with Mongolia’s trade partners.
Sampling: The CRC may require samples of the equipment for laboratory testing and evaluation during the certification process.
Processing Time: A decision on the issuance of a conformity certificate is typically made within 10 working days after receiving a complete application.
Surveillance: Certified equipment is subject to post-market surveillance (audits) to ensure continued compliance. These audits are conducted annually starting one year after the certificate is issued.
Certification Schemes and Validity
The regulation defines four specific certification schemes based on the nature of the equipment and its origin:
Scheme 1a (Import with Samples): Valid for 4 years. Requires documentation review and sample testing.
Scheme 4 (Domestic Production): Valid for 4 years. Includes on-site evaluation of the production process.
Scheme 6 (Export): Valid for 3 years. Includes documentation review and production process evaluation.
Scheme 7 (Import without Samples): Valid for 3 years. Used when providing samples is not possible; requires comprehensive documentation and manufacturer declarations.
Labeling Requirements
Upon receiving the conformity certificate, the applicant is authorized to use the "Certification Mark" (Conformity Mark). The CRC maintains intellectual property rights over the mark, and it must be applied to the certified equipment as proof of compliance with Mongolian regulatory standards.
Legal Framework
This regulation is enacted based on Article 9.1.3 of the Law on Communications, Article 20.3 of the Law on Radio Waves, and Article 14.3 of the Law on Standardization, Technical Regulation, and Conformity Assessment Accreditation. It serves to regulate the certification, issuance, and revocation of conformity certificates for ICT equipment entering or being produced in the Mongolian market.
