Refurbished Products: Refurbished digital technology products that fall under the specified HS codes are prohibited from importation, regardless of whether they have been restored to function like new.

Exemptions: Used machinery, equipment, and production lines that meet specific legal criteria are exempt if they are intended for direct use in investment projects related to the production, packaging, or testing of semiconductor integrated circuits, or for training and R&D activities in digital technology services.

Application Rules for HS Codes

If the prohibited list specifies a 4-digit heading, the ban applies to all 8-digit HS codes within that heading.

If the list specifies a 6-digit subheading, the ban applies to all 8-digit HS codes within that subheading.

If the list specifies an 8-digit code, the ban applies strictly to that specific 8-digit code.

Implementation and Transition

Effective Date: This circular enters into force on January 1, 2027.

Supersession: It replaces the previous Circular No. 11/2018/TT-BTTTT dated October 15, 2018.

Existing Authorizations: Goods previously granted an import permit by competent authorities before the effective date may continue to be imported according to the terms and duration of those specific permits.
