Transition Facilitation (Quality Control) Order, 2026
The Ministry of Commerce and Industry, through the Department for Promotion of Industry and Internal Trade (DPIIT), issued the Transition Facilitation (Quality Control) Order, 2026, on 25 June 2026.
The Order introduces a mechanism for companies to obtain permission from DPIIT, allowing manufacturers supplying these companies to use the BIS Scheme II certification route for certain products covered under existing Quality Control Orders (QCOs).
Scope
The Order covers 10 QCOs relating to products such as toys, protective footwear, air conditioners and their components, rubber and leather footwear, domestic water heaters, washing machines, hinges, furniture, and household and commercial electrical appliances.
It came into effect on 25 June 2026 and will remain in force for five years unless extended by the Central Government.
Key Provisions
1. BIS Certification Requirements
Products covered under the Order must continue to comply with the relevant Indian Standards. However, manufacturers supplying companies that have received specific permission from DPIIT may obtain a BIS licence under Scheme II of Schedule II of the BIS (Conformity Assessment) Regulations, 2018.
The Order does not exempt products from complying with Indian Standards.
2. Permission from DPIIT
Companies incorporated under the Companies Act, 2013, may apply for permission under the Order. Approval will depend on a risk assessment carried out by an Implementation Committee constituted by DPIIT.
Any permission granted may be subject to specific conditions.
3. Assessment Criteria
The Implementation Committee will consider several factors while evaluating applications, including:
  • Technical capability and relevant industry experience.
  • Quality assurance measures across the supply chain, including control over product design and manufacturing.
  • Past compliance record and regulatory conduct.
  • Commitment to developing supply-chain capabilities in India through technology adoption, design capabilities or research and development.
  • A record of complying with the relevant QCO for three consecutive years without default.
  • Any other factors considered relevant by the Committee.
The Committee may also seek supporting documents, declarations, certifications, undertakings or independent assessments before making its recommendations.
4. Market Surveillance
BIS, in consultation with DPIIT, will monitor products covered under the Order to ensure continued compliance with the applicable Indian Standards. Surveillance may be carried out directly by BIS or through notified agencies.
5. Suspension or Withdrawal of Permission
The Central Government may suspend, modify or withdraw permission if a company breaches the conditions of approval, provides incorrect material information or fails to ensure that its products meet the applicable Indian Standards.
The company must be given an opportunity to be heard before such action is taken.
6. Application Timeline and Validity
Applications for permission will be accepted within 24 months from the commencement of the Order.
The Order itself will remain in force for five years. However, permissions granted before its expiry may continue for the period specified in the respective approvals, unless withdrawn, suspended or modified.
DPIIT will issue separate guidelines covering the application process, required documentation, entitlements, monitoring and compliance requirements.
Overall Impact
The Order provides an alternative BIS certification route for manufacturers supplying companies approved by DPIIT. It may be particularly relevant for businesses with established quality-control systems, strong supplier-management practices and plans to develop manufacturing or supply-chain capabilities in India.
However, the arrangement is subject to DPIIT approval and does not remove the requirement to comply with applicable Indian Standards.
The practical benefits and procedures will depend on the detailed guidelines issued by DPIIT.
