NICTA Public Consultation: Review of the National ICT Act of 2009
The National Information and Communications Technology Authority (NICTA) is conducting a public consultation on proposed amendments to the National ICT Act of 2009.
Proposed Changes:
Harmonization of the NICT Act with the Public Finance Management Act (PFMA).
Exemption of NICTA from the Non-Tax Revenue Administration Act of 2022.
Allow NICTA to seek independent auditors for annual audits.
Introduce qualifiers to prevent abuse and higher qualifications to protect NICTA's independence.
Remove the ICT Appeals Panel constitution from the ICCC and Treasury Department.
Review appeal timing under certain provisions.
Bring back prosecution functions to NICTA.
Harmonize Section 89(2) with the PFMA, allowing interest earned on fund money to remain with NICTA.
Increase private sector representation or allow for proxies to vote in the UAS Board.
Amend Section 108(6) and (7) to allow UAS projects to be "deemed approved."
Free up the competitive selection process to allow for a 'pay or play' model.
Introduce new provisions regarding emergency services and the role of ICT.
Add a new part on cybersecurity and resilience.
Impact on Stakeholders:
Stakeholders are encouraged to provide views on pressing issues, missing topics/clauses, and areas needing revision in the Act.
Feedback is sought on whether the proposed amendments alleviate concerns as industry participants.
