Ley 21.695: Interoperability of Mobile Information and Telecommunications Devices and Chargers
Scope
This law mandates common interoperability between mobile information and telecommunications devices and their chargers in Chile.
Key Requirements
Providers must ensure common interoperability between devices and charging devices via compatible charging interfaces and communication protocols.
Retailers must offer consumers the option to purchase devices with or without chargers separately.
Tying the purchase of a device to the purchase of a charger is prohibited.
Retailers must provide clear information about charger compatibility and inclusion.
Technical Specifications and Classes of Devices
A regulation issued by the Ministry of Economy, Development, and Tourism will specify the technical requirements, categories/classes of devices and obligations, including those for mobile phones and laptops.
Penalties
Non-compliance with these requirements will be sanctioned according to Article 24 of Law N° 19.496.
Transitory Provisions
Mobile phones must comply within two years of the law's publication.
Other mobile information and telecommunications devices have four years to comply.
The Ministry of Economy, Development, and Tourism must issue the regulation within 180 days of the law's publication.
Modifies
This law modifies Law N° 19.496, which establishes rules for the Protection of Consumer Rights.
