Posted by Admin in Argentina - 05-DEC-24
The Secretariat of Industry and Trade of the Ministry of Economy of the Republic of Argentina published Resolution 237/2024, which approves the GENERAL CONFORMITY ASSESSMENT FRAMEWORK, establishing the obligation to follow the ‘Conformity Marking’ presented in the annex of the same resolution, which will be enforceable from 31 March 2025 (180 days after the entry into force of the Resolution -2 September 2024-) - until then the devices already marked with the current marking can continue to use it.
Regarding the Conformity Assessment Bodies, this Resolution defines the necessary Accreditations and the Obligations of the Conformity Assessment Bodies.
The Resolution establishes that the Conformity Assessment will require a Sworn Declaration of Conformity that will guarantee that the products that are introduced into the national market comply with the requirements established in the Technical Regulation and that their conformity has been verified through the conformity assessment procedure foreseen, and that it must accompany the product, or family of products, and be available to anyone who requires it. For this reason, the manufacturer or importer may provide a physical copy of it, or have a digital copy available. Said Sworn Declaration of Conformity shall be written in Spanish and shall contain the necessary information to identify the product or family of products, the technical standard, if applicable, and the conformity assessment procedure to which it was submitted.
The Resolution also establishes the criteria to be met by a laboratory in the event that laboratory testing is required as a conformity assessment procedure.
In the event that Product Certification is required as a conformity assessment procedure, the Resolution establishes which certificates will be considered valid and also specifies that each technical regulation will establish the certification modalities admitted.
It also regulates the Extensions and Transfers of Certificate Ownership and their associated procedures, as well as certain Specific Procedures such as the Admission of Technical Equivalence, Adaptation to the Local Market, and the Admission of Goods without Right of Use.
This Resolution also addresses the Compliance Control processes through the mechanisms of Documentary Verification, Technical Verification and Border Control, as well as the Compliance Control Specifications.
Next, the Resolution defines the Technical Consultation Channel, in this case through the ‘Plataforma de Trámites a Distancia’ (TAD) and finally defines the Infractions and Fines for non-compliance with the provisions of the Resolution.
